Want a trademark lawyer to check it?
We search the register for your name and its look-alikes and sound-alikes, grade each close mark by risk, and tell you whether to file, on a free 15-minute call. Filing starts at ₹799 per class plus the government fee.
Send my name on WhatsAppA first check, not legal advice. It does not query the register: it tells you what to search and flags common grounds for refusal under sections 9 and 11 of the Trade Marks Act, 1999. Nothing you type leaves your browser unless you send it to us.
Quick answer
Search the Trade Marks Registry’s free public search at tmrsearch.ipindia.gov.in in every class you will trade in, using three searches: a wordmark search for the name and its variants, a phonetic search for sound-alikes, and a Vienna code search if you have a logo. The helper above builds the list of variants and classes for you and flags words in the name that usually lead to a refusal. Since 1 July 2026 the search opens with a one-time password; it stays free and needs no account.
How to read the results
| Status on the register | What it means for you |
|---|---|
| Registered, Accepted, Advertised | Live rights. A close match in the same or a related class is a serious obstacle. |
| Objected, Formalities Chk Pass | Pending. If it proceeds it ranks ahead of you from its filing date. |
| Abandoned, Refused, Withdrawn, Removed | Not a right on the register, but read why: a refusal as descriptive tells you what will happen to yours, and an abandoned mark may still be in use. |
Every status is explained in our trademark status guide, and the full method in how to use the IP India public search.
What makes a name hard to register
Two sections of the Trade Marks Act, 1999 do most of the refusing. Section 9 refuses marks that describe the goods, their quality or their origin, that are customary in the trade, or that are deceptive, likely to hurt religious feelings or barred under the Emblems and Names (Prevention of Improper Use) Act, 1950. Section 11 refuses marks identical or similar to an earlier mark for similar goods or services, judged by sound, appearance and idea together. Similar goods reach across classes: clothing in class 25 conflicts with retail of clothing in class 35, software in class 9 with software services in class 42, and restaurants in class 43 with packaged food in classes 29 and 30.
The strongest marks are invented or arbitrary words; the weakest describe what is in the box.
What the public search does not show
- Applications filed in the last few days, which take time to appear.
- Unregistered marks in use, which have rights under passing-off law.
- Company names on the MCA register, domain names and social handles, which do not block a trademark but show who may object.
- International registrations designating India that are still in process.
A professional search covers these, grades each close mark by risk and proposes a specification that steers around them.
What filing costs
The government fee is ₹4,500 per class for individuals, sole proprietors, DPIIT-recognised startups and Udyam-registered small enterprises, and ₹9,000 per class for others. Our professional fee starts at ₹799 per class and includes the search, classification and filing; see trademark registration and the full fee schedule.
Frequently asked questions
Is trademark search free in India?
Yes. The IP India public search is free and covers every application and registration on the Indian register. Since 1 July 2026 each visit starts with a one-time password sent to your email or mobile; there is no account and no fee.
How do I check if a brand name is already registered?
Run a wordmark search in every class you will trade in, then a phonetic search for names that sound alike. Pending applications appear too, and a pending application can block yours. A company name approved by the MCA does not clear a trademark.
If the search shows nothing, is my name safe?
Not necessarily. The name may still be descriptive and refused under section 9, very recent applications may not appear yet, and unregistered marks in use have rights the register does not show.
Which classes should I search?
The class of your goods or services and every related class: a clothing brand checks classes 25 and 35, a software product classes 9 and 42, a restaurant class 43 and the food classes 29 and 30.
Does this tool search the register for me?
No. It builds the search plan: the variants to type, the classes to cover and the words that usually draw an objection. The register itself is searched on the IP India portal, or by us if you send us the name.
